Two decrees relating to the application of the Hamon Law were issued in March 2015.
According to the decree of March 11, 2015, concerning price reduction announcements to consumers, any price reduction announcement is lawful provided it does not constitute an unfair commercial practice. It is specified that, in the case of an announcement made in a commercial establishment, the labeling, marking, or display of prices must include:
- the announced reduced price,
- the reference price which is determined by the advertiser and from which the price reduction.
Similarly, a price reduction of a uniform rate, applicable to clearly identified products or services, may be applied through a cash discount. In this case, this method must be disclosed.
Finally, the decree specifies that the advertiser must be able to justify the accuracy of the reference price from which the price reduction is advertised.
Published in the Official Journal on March 25, 2015, the decree of March 17, 2015, concerning prior information for consumers regarding personal services, establishes, in addition to the existing display requirements, a list of information relating to both the service provider and the services they provide.
