The Law for a Digital Republic dated October 7, 2016 (law no. 2016-1321) provides for open data of court decisions, that is to say the free provision to the public of all court decisions.
However, since this law was passed, little progress has been made and no publication schedule has been established.
The case is indeed complex, with numerous issues relating in particular to:
- the tools and technical investments to be made
- the protection of the privacy and personal data of litigants
- the protection of the magistrates' names
Under pressure from the Council of State, the schedule for making open data available to the public was unveiled on April 28, 2021 by decree.
