The Law for a Digital Republic dated October 7, 2016 (law no. 2016-1321) provides for open data of court decisions, that is to say the free provision to the public of all court decisions.

However, since this law was passed, little progress has been made and no publication schedule has been established.

The case is indeed complex, with numerous issues relating in particular to:

  • the tools and technical investments to be made
  • the protection of the privacy and personal data of litigants
  • the protection of the magistrates' names

Under pressure from the Council of State, the schedule for making open data available to the public was unveiled on April 28, 2021 by decree.

The dates are as follows:

September 30, 2021 Council of State and Court of Cassation
March 31, 2022 Administrative Courts of Appeal
April 30, 2022 Court of Appeal (civil, commercial and social litigation)
June 30, 2022 Administrative courts
June 30, 2023 Industrial tribunals
December 31, 2024 Commercial courts and courts of first instance in matters of minor offenses and misdemeanors
September 30, 2025 Judicial courts
December 31, 2025 Court of Appeal (in matters of minor offenses, misdemeanors and criminal matters)

Almost 10 years will have passed before it is made available to the public…
