The Court of Cassation reiterates that "the use, by an employee, of his working time for purposes other than those for which he receives remuneration from his employer constitutes a breach of trust".

In this case, the employee used his working time and the resources made available to him by his employer to carry out a personal, paid activity for the benefit of a third party—the manufacture of prostheses.
According to Article 314-1 of the Penal Code, breach of trust is punishable by three years' imprisonment and a fine of €375,000.
