The Court of Cassation recalls that "the use, by an employee, of his working time for purposes other than those for which he receives remuneration from his employer constitutes a breach of trust".

In this case, the employee had used his working time and the means made available to him by his employer to carry out a personal and remunerated activity for the benefit of a third party - manufacture of prostheses.
According to article 314-1 of the Criminal Code, breach of trust is punishable by three years' imprisonment and a fine of 375,000 euros.
